By accessing or using TradeBuilt, you acknowledge that you have read, understood, and agreed to these Terms of Use. If you do not agree, do not use TradeBuilt.

Professional Use Only

TradeBuilt is an HVACR calculation and reference tool. It is not a substitute for professional training, experience, judgment, manufacturer documentation, equipment data plates, approved service procedures, engineering requirements, applicable codes, laws, regulations, licensing requirements, or established safety practices.

The user is solely responsible for possessing the training, qualifications, licenses, certifications, knowledge, tools, and authorization required for any work performed.

TradeBuilt does not authorize, approve, certify, direct, supervise, or determine the safety of any installation, diagnosis, service procedure, repair, adjustment, measurement, charging procedure, recovery procedure, electrical procedure, combustion procedure, or other work.

User Responsibility and Verification

Every value, calculation, conversion, result, reference, pressure temperature value, diagnostic indication, target, range, and other output provided by TradeBuilt must be independently verified by the user before it is relied upon or used to perform work.

TradeBuilt calculates results using information entered, measured, or selected by the user together with formulas, constants, reference data, and software logic. Results can be affected by incorrect inputs, inaccurate measurements, instrument error, equipment conditions, environmental conditions, refrigerant selection, manufacturer specific requirements, assumptions, constants, rounding, reference data, software defects, or other variables.

The user bears sole responsibility for verifying the accuracy and applicability of all inputs and outputs against the actual equipment, manufacturer documentation, approved service information, equipment labeling, and applicable codes and regulations.

If TradeBuilt conflicts with manufacturer documentation, equipment labeling, approved service information, applicable law, code, regulation, or an authority having jurisdiction, do not rely on TradeBuilt. Follow the controlling requirement.

Hazardous Work

HVACR work can cause serious bodily injury, death, property damage, equipment damage, environmental harm, fire, or explosion.

Hazards include, but are not limited to, electrical shock, electrocution, arc flash, high voltage, pressurized systems, stored energy, refrigerant release, flammable refrigerants, combustible fuels, fire, explosion, carbon monoxide, combustion products, rotating or moving equipment, hot surfaces, extreme temperatures, confined spaces, elevated work areas, and hazardous substances.

TradeBuilt cannot observe the equipment, worksite, tools, instruments, environmental conditions, technician, or procedure being performed. A result displayed by TradeBuilt is never a determination that an action is safe.

The user is solely responsible for identifying hazards and following all required safety procedures, including applicable lockout and tagout procedures, personal protective equipment requirements, manufacturer procedures, refrigerant handling requirements, electrical safety requirements, fuel and combustion safety requirements, environmental regulations, codes, laws, and workplace safety requirements.

Do not perform work for which you are not properly trained, qualified, equipped, licensed, or authorized.

No Diagnostic Guarantee

TradeBuilt does not guarantee that a calculation, measurement, result, target, range, comparison, or other information identifies the condition of a system, establishes the cause of a malfunction, confirms a diagnosis, verifies proper operation, or establishes that equipment is safe to operate.

The technician remains solely responsible for diagnosis, troubleshooting, service decisions, repairs, adjustments, verification of proper operation, and determining whether equipment can safely be returned to service.

No Manufacturer, Engineering, or Regulatory Authority

TradeBuilt USA is not the manufacturer of the equipment being serviced and does not act as an engineer, authority having jurisdiction, regulatory agency, code authority, certification body, or equipment manufacturer.

Nothing provided by TradeBuilt constitutes manufacturer approval, engineering approval, code compliance, regulatory approval, certification, or authorization to perform any procedure.

No Warranty

TradeBuilt is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by applicable law, TradeBuilt USA and its owners, officers, employees, developers, affiliates, licensors, data providers, and contributors disclaim all warranties and representations, express, implied, statutory, or otherwise, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, title, noninfringement, and suitability for any particular system, equipment, diagnosis, repair, procedure, or application.

TradeBuilt USA does not warrant or guarantee that TradeBuilt, its software, calculations, formulas, constants, reference information, refrigerant data, conversions, instructions, or results are accurate, complete, current, error free, or suitable for any particular use.

Assumption of Risk

The user knowingly and voluntarily assumes the risks associated with using TradeBuilt and with performing HVACR work.

The decision to act upon any information provided by TradeBuilt belongs exclusively to the user. TradeBuilt does not control the user’s measurements, instruments, equipment, working conditions, procedures, decisions, or actions.

Use of TradeBuilt does not transfer responsibility for those decisions or actions to TradeBuilt USA.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRADEBUILT USA AND ITS OWNERS, OFFICERS, EMPLOYEES, DEVELOPERS, AFFILIATES, LICENSORS, DATA PROVIDERS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY CLAIM, LOSS, DAMAGE, INJURY, DEATH, EXPENSE, OR LIABILITY ARISING FROM OR RELATING TO THE USE OF, INABILITY TO USE, MISUSE OF, OR RELIANCE UPON TRADEBUILT OR ANY INFORMATION OR RESULT PROVIDED BY TRADEBUILT.

This limitation includes, without limitation, personal injury, death, property damage, equipment damage, system failure, electrical damage, fire, explosion, refrigerant release or loss, environmental damage, improper charging, improper recovery, incorrect diagnosis, improper repair, loss of product, loss of data, business interruption, lost profits, lost revenue, and direct, indirect, incidental, consequential, special, exemplary, or punitive damages.

The user remains solely responsible for every decision made and every action performed using information obtained from TradeBuilt.

Copyright and Intellectual Property

TradeBuilt, the TradeBuilt name, TradeBuilt branding, logos, trade dress, application design, user interface, visual elements, graphics, artwork, icons, text, written content, documentation, organization, presentation, original reference materials, software, source code, and other original content contained within or associated with TradeBuilt are the property of TradeBuilt USA and are protected by applicable United States and international copyright, trademark, intellectual property, and other laws.

Except where expressly permitted in writing by TradeBuilt USA or otherwise permitted by applicable law, no portion of TradeBuilt or its original content may be copied, reproduced, republished, distributed, transmitted, displayed, modified, adapted, translated, sold, licensed, sublicensed, scraped, extracted, reverse engineered, decompiled, disassembled, redistributed, incorporated into another application, website, service, database, publication, training product, commercial product, or derivative work.

No person or entity may use the TradeBuilt name, branding, logos, graphics, screenshots, application appearance, or other protected materials in a manner that falsely suggests affiliation with, sponsorship by, endorsement by, or authorization from TradeBuilt USA.

Access to or purchase of TradeBuilt grants the user only the limited right to use the application for its intended purpose. Purchase, download, installation, or use of TradeBuilt does not transfer ownership of TradeBuilt or any intellectual property rights associated with it.

HVACR principles, mathematical formulas, industry standards, manufacturer information, refrigerant properties, terminology, and other material that is independently in the public domain or owned by third parties are not claimed as the exclusive intellectual property of TradeBuilt USA. TradeBuilt USA claims rights only to the extent legally applicable to its original software, expression, selection, arrangement, presentation, design, documentation, branding, and other protectable material.

All third-party names, trademarks, service marks, product names, manufacturer names, and other intellectual property remain the property of their respective owners. Their appearance within TradeBuilt, where applicable, does not imply affiliation, sponsorship, endorsement, or ownership by TradeBuilt USA.

Unauthorized use of TradeBuilt USA intellectual property may result in enforcement of all rights and remedies available under applicable law.

TradeBuilt USA expressly reserves all rights not specifically granted.

Acceptance

By using TradeBuilt, you acknowledge that HVACR work involves potentially dangerous conditions, that TradeBuilt cannot evaluate the conditions present at a worksite, and that you are responsible for independently verifying information before acting upon it.

If you cannot independently verify a TradeBuilt result or safely determine whether it applies to the equipment and conditions in front of you, do not act on that result.
